Talking Stick commercial financing

Talking Stick financing is about the resort, entertainment, retail, and office on Salt River Pima-Maricopa Indian Community land along Loop 101. Many of those buildings sit on a ground lease. This page explains that only in general terms. It is not legal advice and not a tribal ruling.

The Salt River Pima-Maricopa Indian Community is a federally recognized tribe. Its land includes the Loop 101 corridor where Talking Stick Resort, the casino, golf, retail pavilions, and some office buildings sit. Visitors use Scottsdale street addresses. The landlord on a commercial site is often the Community, or an entity of the Community, under a ground lease. Capital Market Funds is not that landlord, not the tribe, and not a broker for tribal land sales.

A fee-simple Scottsdale office building and a leasehold at Talking Stick are different files. The first is a deed. The second is a contract that lets the tenant occupy and improve land the tenant does not own in the usual way. We can arrange a conversation with capital sources that will look at leasehold collateral. We cannot tell you that a given lease is financeable. That judgment belongs to the lender’s counsel and to yours. The city page sponsors still use for nearby Scottsdale property is Scottsdale.

What a ground lease changes, in plain terms

On a ground lease, the lender is looking at the lease and the building, not at a warranty deed to the dirt. Typical questions are how many years remain, whether the lease can be pledged, what happens if the tenant defaults, and who has to approve a loan. Those answers are in the lease and in the Community’s process. They are not on this website. We do not state a required term, a Bureau of Indian Affairs step, or a court outcome, because those depend on the parcel and the documents.

Bring the lease, a summary your lawyer is willing to stand behind, and the rent roll for the improvements. If you do not have the lease yet, the file is not ready. Public indexes on the rates and calculator are not a Talking Stick quote.

Resort, retail, and office are still different rent rolls

Talking Stick Resort is a hotel. Casino and entertainment operations are not the same collateral as a shop lease at the pavilions, and an office suite at a project such as Riverwalk is not a hotel room. Name the building. Hospitality notes are on Arizona hospitality. Retail notes are on Arizona retail. The markets list is Markets.

We arrange the senior loan from the Scottsdale office when a capital source will consider the leasehold. Arizona bank financing is the portfolio comparison for a smaller building, and only if that bank will accept the collateral. Many banks will not. That is a credit decision, not a promise from this page.

Talking Stick questions

Do you give legal advice on tribal land?
No. This page only says that Talking Stick commercial sites are often ground leases on Salt River Pima-Maricopa Indian Community land, and that lenders underwrite the lease. It does not state a statute, an approval checklist, or an outcome. Use a lawyer for that.
Is Talking Stick a City of Scottsdale office district?
Mailing addresses often say Scottsdale. The land is Community land. A fee-simple building inside the city limits is a different file and belongs on the Scottsdale page or the page that matches that building.
Will every bank finance a Talking Stick ground lease?
No. Some capital sources will not take leasehold collateral. We can ask the ones that might. We do not promise an approval, and we are not the lender. The office is in Scottsdale at 7373 E Doubletree Ranch Rd #255.
